EstateSaleFinder.net ("EstateSaleFinder," "we," "us," or "our") is committed to protecting your personal information. This Privacy Policy explains what data we collect, why we collect it, how we use and share it, how long we retain it, and what rights you have over it. This policy applies to all users of EstateSaleFinder.net including buyers, estate sale operators, and franchise partners.

2. Information We Collect

2.1 Information You Provide Directly

  • Account registration: name, email address, phone number, password
  • Business profile information: company name, service area, years in business, specialty categories, franchise brand and territory
  • CRM data: client contact information, notes, pipeline status, and related records entered by estate sale operators into the ESF CRM
  • Payment information: processed by Stripe. We do not store full card numbers. We retain transaction records and billing details.
  • Communications: messages you send us via contact forms, email, or support chat

2.2 Information Collected Automatically

  • Usage data: pages visited, features used, time spent, clicks, search queries
  • Device and browser data: IP address, browser type, operating system, device identifiers
  • Location data: approximate location derived from IP address

2.3 Information from Third Parties

  • Franchise verification data provided at onboarding
  • Analytics data from platform usage tools

3. How We Use Your Information

  • To provide, operate, and improve the EstateSaleFinder platform
  • To process payments and manage subscriptions via Stripe
  • To power the AI pricing appraiser (item data is processed via Google Gemini API — see Section 5)
  • To send transactional emails (account confirmations, sale alerts, settlement notifications)
  • To send marketing communications where you have opted in
  • To verify franchise partner applications
  • To analyze platform usage and improve features
  • To comply with legal obligations

4. Legal Basis for Processing (GDPR)

For users in the European Economic Area, our legal bases for processing personal data are: (a) contract performance — processing necessary to deliver our services; (b) legitimate interests — platform security, fraud prevention, and service improvement; (c) consent — for marketing communications and non-essential cookies; and (d) legal obligation — where required by applicable law.

5. Third-Party Service Providers

We share data with the following processors who handle data on our behalf under signed Data Processing Agreements:

  • Supabase — database hosting and backend infrastructure
  • Stripe — payment processing and billing
  • Google (Gemini AI) — AI-powered item identification and pricing. Item photos and descriptions submitted to the appraiser are processed by Google's Gemini API. We do not send personally identifiable information to Gemini unless you include it in an image or description.
  • Email service provider — transactional and marketing email delivery
  • Analytics provider — platform usage analytics

We do not sell your personal data to third parties. We do not share your data with advertisers.

6. CRM Data — Special Provisions

Estate sale operators who use the ESF CRM tool enter data about their own clients ("Operator Client Data"). This data may include names, contact information, and notes about families and estates. EstateSaleFinder acts as a data processor with respect to Operator Client Data. The operator is the data controller and is responsible for ensuring they have the legal right to enter and store that data in our platform. We process Operator Client Data solely to provide the CRM service. See our CRM Data Addendum for full terms.

7. Data Retention

  • Active account data: retained for the life of the account
  • CRM records: retained for 24 months after account cancellation, then permanently deleted unless export is requested
  • Payment records: retained for 7 years for tax and legal compliance
  • Usage and analytics data: retained for 24 months
  • Marketing consent records: retained for 5 years
  • Deleted account data: purged within 30 days of deletion request, except where retention is required by law

8. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Right to access — request a copy of the personal data we hold about you
  • Right to correction — request correction of inaccurate or incomplete data
  • Right to deletion — request deletion of your personal data ("right to be forgotten")
  • Right to portability — request your data in a portable format
  • Right to object — object to processing based on legitimate interests
  • Right to opt out of sale/sharing — California residents may opt out of the sale or sharing of personal data under CCPA/CPRA
  • Right to withdraw consent — withdraw consent for marketing or non-essential cookies at any time

10. Data Security

We implement industry-standard security measures including encryption in transit (TLS), encryption at rest for sensitive data, access controls, and regular security reviews. Supabase provides SOC 2 compliant infrastructure. However, no system is 100% secure. In the event of a data breach affecting your rights and freedoms, we will notify affected users and relevant authorities within 72 hours as required by applicable law.

11. Children's Privacy

EstateSaleFinder is not directed at children under 13. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us immediately at [email protected].

12. Florida Digital Bill of Rights

Florida residents have rights under the Florida Digital Bill of Rights (FDBR), effective July 1, 2024, including the right to access, correct, delete, and obtain a copy of personal data, and the right to opt out of targeted advertising. To exercise these rights, contact [email protected].

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes via email and update the "Last updated" date at the top of this page. Continued use of the platform after changes constitutes acceptance of the updated policy.
