1. Acceptance of Terms

By creating an account or using EstateSaleFinder.net ("Platform," "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users including buyers, estate sale operators, and franchise partners.

2. Description of Service

EstateSaleFinder is an AI-powered marketplace connecting estate sale buyers with estate sale operators. The Platform provides: sale discovery and listing tools for buyers; Pro business tools (AI pricing, bulk upload, buyer leads, social automation, CRM) for estate sale operators; and a Franchise Partner Program for franchisees of partner brands.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your login credentials. You must notify us immediately of any unauthorized access to your account. You must be at least 18 years old to create an account.

4. Operator Accounts and Pro Plans

Estate sale operators may subscribe to ESF Pro on a monthly basis, billed via Stripe. Franchise partners accepted into the Franchise Partner Program receive 6 months of Pro access at no charge, subject to verification. Pro features are licensed for use by the subscribing business only and may not be resold or sublicensed. We reserve the right to modify Pro plan features with 30 days notice to active subscribers.

5. CRM Tool — Operator Responsibilities

The ESF CRM tool allows operators to store and manage client contact data. By using the CRM, you represent and warrant that:

You have obtained all necessary consents and have the legal right to enter, store, and process the personal data of the individuals in your CRM records
You will use CRM data only for legitimate business purposes related to your estate sale operations
You will not enter sensitive personal data categories (health, financial account numbers, government IDs) into the CRM unless strictly necessary
You will not export CRM data for use outside the Platform except for your own legitimate business records
You are the data controller for all Operator Client Data and are responsible for compliance with applicable privacy laws regarding that data

EstateSaleFinder acts as a data processor with respect to Operator Client Data and processes it solely to provide the CRM service. See the CRM Data Addendum for full terms.

6. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose
Post false, misleading, or fraudulent sale listings
Scrape, harvest, or systematically extract data from the Platform
Attempt to gain unauthorized access to any part of the Platform or its infrastructure
Use the Platform to spam, harass, or send unsolicited commercial messages
Misrepresent your identity, credentials, or franchise affiliation
Use another user's account or share your credentials

7. Listings and Content

Operators are solely responsible for the accuracy and legality of their sale listings, photos, and descriptions. By submitting content to the Platform, you grant EstateSaleFinder a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content in connection with the Service. You represent that you own or have the right to submit all content you post.

8. AI Pricing Tool — Disclaimer

The ESF AI Appraiser provides estimated price ranges based on publicly available sold listing data. These estimates are for informational purposes only and do not constitute a formal appraisal, guarantee of value, or professional valuation. EstateSaleFinder makes no warranty regarding the accuracy of AI-generated pricing estimates. Users rely on AI pricing estimates at their own risk.

9. Payment Terms

Pro subscriptions are billed monthly in advance via Stripe. We offer a 30-day money-back guarantee: if you request a refund within 30 days of a payment, we will refund that payment in full, no questions asked. After the 30-day window, fees are non-refundable except as required by law or as expressly stated in writing. We reserve the right to change pricing with 30 days written notice to active subscribers. Failure to pay may result in suspension of Pro features. Your existing listings remain live even after you cancel.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESTATESALEFINDER'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ESTATESALEFINDER IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. IN NO EVENT SHALL ESTATESALEFINDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless EstateSaleFinder and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform in violation of these Terms or applicable law; (b) content you submit to the Platform; (c) Operator Client Data you enter into the CRM; or (d) your violation of any third party's rights.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform. You may cancel your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately. CRM data is retained for 24 months post-cancellation and then deleted unless you request an export before that time.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Pinellas County, Florida. You waive any objection to jurisdiction and venue in these courts.

15. Changes to Terms

We may update these Terms from time to time. We will notify active users via email of material changes at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
