Referral Program Agreement

Version 2026-09-14. This Agreement is between you (the "Referrer") and EstateSaleFinder ("we", "us"). You agree to it by ticking the agreement box and typing your name on your Referrals & Earnings page. You must accept this Agreement before your referral link can earn cash.

1. Independent Contractor

You are an independent contractor, not an employee, partner, agent or joint venturer. You decide when and how you promote us. You have no authority to make promises, sign anything, or speak on our behalf. We do not withhold taxes and we provide no employee benefits.

2. What You Earn

• $20 per month for each referred estate sale company on a qualifying paid plan of $99/month or more (the amount is the same $20 whether they pay $99, $149 or $199).
• $10 per month for each referred Booth Max seller.

Commission accrues for each month the referred account actually pays, beginning with the first month after any free trial converts to a paid subscription, and stopping when the account cancels, is refunded, or moves to a plan that does not qualify. Free accounts, trial accounts, one-time purchases (including the $49 single-sale listing) and plans below $99 earn nothing.

We may change commission rates with 30 days' notice. Referrals already earning keep their existing rate for as long as that account keeps paying.

3. What Qualifies

• One Referrer per referred account. Where a referred account has clicked more than one link, the most recent click within 90 days is credited.
• The referred account must be a new account, not an existing or previously cancelled customer returning.
• You do not earn for recruiting other Referrers, only for referred paying accounts.
• Self-referrals do not qualify. This includes your own accounts, accounts sharing your company, EIN, address or payment card, and accounts you control.

4. Payment

• Commission is calculated monthly and shown on your dashboard as it accrues.
• We pay out once your unpaid balance reaches $20. Balances below that carry forward and are never forfeited.
• Payouts are made by hand each month after the month closes, using the payment method you provide.
• Before your first payout you must submit your legal name, address and taxpayer identification number. Payments are held until those details are on file.
• If a referred account is refunded or charges back, the matching commission is reversed on your next statement.

5. Taxes

Commission is taxable income and you are responsible for reporting and paying all taxes on it. If we pay you $600 or more in a calendar year we will issue an IRS Form 1099-NEC to the name and taxpayer ID you provided. Incorrect tax information may delay your payment or require backup withholding.

6. How You May Promote Us

• No unsolicited email, text or messaging (no spam), and no purchased or scraped lists.
• No paid search or paid social ads bidding on our brand terms, domains or misspellings.
• No coupon, cashback or deal sites, no cookie stuffing, no forced clicks, no automated traffic.
• No impersonating us, no fake reviews, and no claims about earnings, features or pricing that we have not published.
• You must disclose that you earn a commission wherever you share your link, as required by the FTC Endorsement Guides.

7. Earnings Are Not Guaranteed

Most Referrers refer nobody or one account. Nothing in this program is a promise of income. Your results depend entirely on who you know and whether they choose to subscribe and stay subscribed.

8. Pausing, Removal and Withholding

We may pause your earning, remove you from the program, or withhold or reverse commission, at our discretion and effective immediately, where we reasonably believe there has been fraud, self-referral, abuse, spam, cookie stuffing, brand-term bidding, misrepresentation, a breach of this Agreement or our Terms of Service, or any conduct that harms our reputation or our customers. We record the reason and show it on your Referrals & Earnings page.

• Paused: no new monthly commission accrues from that point. Commission properly earned before the pause, and not subject to reversal, is still paid to you on the normal schedule.
• Removed: your participation ends and you may not rejoin. Commission properly earned before removal, and not subject to reversal, is still paid.
• Where the conduct involves fraud or chargebacks, we may withhold amounts reasonably related to that conduct until it is resolved.

You may leave the program at any time by telling us in writing; earned, non-reversible commission is still paid. Either of us may end your participation with written notice, and notice by email to the address on your account is written notice.

9. Suspending or Ending the Program

This is a promotional program, not a permanent entitlement. We may close it to new members at any time, and we may suspend or end it entirely for everyone with 30 days' written notice. When the program ends, no commission accrues for months after the end date we give you. Commission you properly earned up to that date, including balances below the payout minimum, is still paid out. We may also change the rates, qualifying plans, minimum payout, or any other term with 30 days' notice; referrals already earning keep their existing rate for as long as that account keeps paying.

10. Confidentiality and Data

You will see only the business name, plan tier and status of accounts you referred, so you can check your own earnings. You may not disclose or use that information for any other purpose, and you may not contact those accounts on our behalf.

11. Changes to This Agreement

We may update this Agreement. Material changes take effect 30 days after we notify you, and continued participation after that date is acceptance. Each version is numbered and the version you signed is recorded with your signature. Where we publish a new version, we may require you to accept it before your next payout; your Referrals & Earnings page tells you when that is the case and commission keeps accruing while you do it.

12. Limitation of Liability and Governing Law

Our total liability under this Agreement is limited to the commission properly owed to you. This Agreement is governed by the laws of the State of Florida, and the courts located in Florida have exclusive jurisdiction over any dispute. Our Terms of Service and Privacy Policy also apply and control if there is any conflict on matters they cover.
