1. Use of the Platform

EstateSaleFinder.net ("Platform," "we," "our," or "us") provides a marketplace for users to discover, list, and interact with estate sales, garage sales, antique and vintage shops, thrift stores, live auctions, antique mall booth inventory, and related content. The Platform also facilitates connections between homeowners and professional estate sale companies.

The Platform operates across all 50 United States. You agree to use the Platform only for lawful purposes and in accordance with these Terms, as well as all applicable federal, state, and local laws and regulations.

You must be at least 18 years old to use this Platform.

2. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your login credentials
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use of your account at [email protected]

We reserve the right to suspend or terminate accounts at our discretion, with or without notice, for violations of these Terms or for any other reason.

3. Types of Sellers

The Platform supports several categories of sellers. Each seller type is expected to adhere to the listing guidelines and spirit of the Platform:

• Estate Sale Companies — Professional companies or individuals hosting estate sales, typically involving the full contents of an entire household or property. Estate Sale listings may include any and all legal items being sold at the sale, without category restrictions.
• Auction Houses — Licensed auctioneers listing upcoming live, online, or hybrid auctions. Firearms auctions are permitted only when the auctioneer holds a valid Federal Firearms License (FFL) and all applicable federal and state laws are followed.
• Storefront Sellers — Vintage shops, antique stores, thrift stores, and similar brick-and-mortar retail establishments. Storefront sellers may display current inventory and specialty information on their profile.
• Booth Sellers — Individual sellers who list items in a personal Booth Gallery within the Collective section. Booth listings are specifically and exclusively intended for vintage, antique, rare, collectible, and unique items. Booth Sellers must not use the Booth Gallery to list new, mass-produced, or commonly available merchandise.
• Garage Sale Hosts — Individuals hosting one-time or recurring garage, yard, or estate clear-out sales. Garage sale listings are free and are not subject to category restrictions beyond the prohibited items in Section 6.
• Event and Fair Organizers — Organizers of flea markets, vintage fairs, antique shows, and similar public events.

All seller types are subject to the listing content guidelines described in Section 4 and the seller responsibilities described in Section 5.

4. Permitted Listing Content & Platform Identity

EstateSaleFinder.net is a curated marketplace built for the estate sale, vintage, antique, thrift, and treasure-hunting community. The Platform is designed to connect sellers of unique, interesting, and hard-to-find items with passionate treasure hunters.

Estate Sale, Garage Sale, and Event Listings: These seller types may list the complete contents of a household, property, or event. There are no category restrictions on these listings beyond the universally prohibited items described in Section 6.

Booth Seller Listings (Collective Section): Booth Sellers in the Collective section are held to a higher standard of curation. Permitted Booth listings include:

• Vintage and antique items
• Rare finds and collectibles
• Thrifted and secondhand goods with character or value
• Unique, interesting, or unusual items
• Handmade or artisan goods

The following categories of listings are strictly prohibited in the Booth Gallery / Collective section and may be removed without notice:

• Brand-new consumer electronics (new phones, laptops, tablets, gaming consoles, etc.)
• New household appliances (new refrigerators, microwaves, washers, etc.)
• Mass-produced retail goods still widely available in stores
• Cars, trucks, motorcycles, boats, or other motor vehicles
• Real estate, land, or property listings
• Generic items more appropriate for general classifieds platforms

Booth Sellers must list only vintage, antique, collectible, rare, or otherwise unique items. The Collective section is not a general classifieds board. Listings that violate the spirit and purpose of the Booth Gallery may be removed at our sole discretion, and repeat offenders may have their accounts suspended or terminated.

5. Seller Responsibilities

All sellers ("Sellers") on the Platform agree that:

• All information provided (including descriptions, photos, dates, and locations) is accurate, truthful, and not misleading
• They have the legal right to sell every item they list
• They have the right to post all uploaded content (photos, videos, descriptions)
• All listed items are legal to sell under applicable federal law and the laws of their state
• Items that are illegal, stolen, recalled, counterfeit, or hazardous may not be listed under any circumstances
• Sellers are solely responsible for collecting and remitting any applicable sales tax as required by their state and local jurisdiction
• Sellers must not list counterfeit, replica, or intentionally misrepresented goods
• Sellers comply with all applicable federal, state, and local laws and regulations
• Estate sale companies and auction houses using the Platform's lead generation features agree to respond to homeowner hire requests honestly, professionally, and in good faith

EstateSaleFinder.net is not responsible for the accuracy or legality of seller listings. The Platform reserves the right to remove any listing that violates these Terms.

6. Prohibited Items

The following items may never be listed on the Platform, regardless of seller type:

• Stolen property or goods obtained through illegal means
• Counterfeit, knockoff, or replica goods misrepresented as authentic
• Firearms, ammunition, or explosives — unless the seller is in full compliance with all applicable federal and state laws (including FFL licensing requirements for dealers), and the listing clearly discloses the nature of the item
• Controlled substances, illegal drugs, or drug paraphernalia
• Hazardous materials, toxic chemicals, or flammable substances not permitted for consumer resale
• Items subject to active Consumer Product Safety Commission (CPSC) recalls
• Items that infringe upon intellectual property rights (trademarks, copyrights, patents)
• Human remains, organs, or bodily fluids
• Protected wildlife products, endangered species parts, or items made from protected animals (ivory, certain furs, etc.) in violation of federal or state law
• Sexual content, obscene material, or any content prohibited under applicable obscenity laws
• Any item whose sale is prohibited by federal law or the laws of the state in which the seller or sale is located

Sellers are solely responsible for verifying that their items comply with all applicable laws. The Platform is not liable for items listed in violation of these prohibitions.

7. Buyer (Treasure Hunter) Responsibilities

Users browsing, interacting with, or purchasing from listings ("Treasure Hunters" or "Buyers") agree that:

• All interactions and transactions are between the buyer and seller; the Platform is a facilitator and is not a party to any transaction
• Buyers must comply with all applicable local, state, and federal laws when purchasing items
• Buyers should inspect items in person before purchasing whenever possible
• The Platform does not guarantee the authenticity, condition, age, provenance, or value of any item listed
• Buyers must not engage in harassment, trespassing, intimidation, or disruptive behavior at estate sales or seller locations
• Buyers are responsible for arranging their own transportation, payment, and pickup of purchased items
• Buyers understand that AI-generated pricing estimates and item identifications are tools to assist in decision-making, not certified appraisals

8. Homeowner Hire Requests

The Platform allows homeowners ("Homeowners") to submit hire requests to connect with professional estate sale companies. By submitting a hire request, Homeowners acknowledge that:

• Information provided in a hire request (including property details, reason for sale, timeline, high-value item descriptions, and uploaded photos) will be shared with one or more matched estate sale companies on the Platform
• The Platform facilitates introductions between Homeowners and estate sale companies but is not a party to any resulting contract or service agreement
• The Platform does not guarantee the quality, availability, or performance of any estate sale company
• Homeowners are responsible for independently verifying the credentials, licensing, and insurance of any company they hire
• EstateSaleFinder.net is not responsible for any disputes, damages, or losses arising from engagements between Homeowners and estate sale companies

Estate sale companies receiving hire requests agree to treat all homeowner information as confidential and to use it only for the purpose of responding to the hire request.

9. AI-Generated Content Disclaimer

The Platform uses artificial intelligence tools — including visual recognition models and market data analysis — to generate item descriptions, pricing estimates, item labels, social media content, and other content.

You acknowledge that:

• AI-generated content may not always be accurate, complete, or up to date
• AI pricing estimates are based on market data and comparable sales but are not certified appraisals and should not be relied upon as such for insurance, estate, tax, or legal purposes
• You should independently verify any important information, including item identification, value, condition, and authenticity
• We are not liable for decisions made based on AI-generated content
• The AI appraiser tool is intended as a general reference, not a substitute for professional appraisal by a qualified appraiser

10. Payments and Subscriptions

Certain features of the Platform require a paid subscription or per-listing fee. All payments are processed through Stripe, Inc., a third-party payment processor. By providing payment information, you agree to Stripe's terms of service and privacy policy, available at stripe.com.

Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time through your account settings. We offer a 30-day money-back guarantee: if you request a refund within 30 days of a payment, we will refund that payment in full, no questions asked. After the 30-day window, cancellations take effect at the end of the current billing period and no partial refunds are provided for unused subscription time unless required by applicable law. Your existing listings remain live even after you cancel.

We reserve the right to change pricing at any time. We will provide at least 30 days' notice of any price changes by email or in-platform notification. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.

EstateSaleFinder.net does not store your full credit card number. All payment card data is handled directly by Stripe in accordance with PCI-DSS standards.

11. Messaging and Communication

The Platform allows users to communicate directly through an in-app messaging system.

You agree not to:

• Send spam, unsolicited advertising, or promotional messages
• Harass, threaten, abuse, or intimidate other users
• Share another user's personal information without their consent
• Use messaging to facilitate transactions outside the Platform for the purpose of evading these Terms

We reserve the right to monitor, restrict, or terminate messaging privileges at any time.

12. User Content

By uploading content (photos, videos, descriptions, reviews, etc.), you grant EstateSaleFinder.net a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for Platform operation and promotion.

You are responsible for ensuring your content does not violate any laws, third-party rights, or these Terms.

We reserve the right to remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

13. Prohibited Activities

You agree not to:

• Use the Platform for fraudulent, deceptive, or illegal purposes
• Upload illegal, harmful, threatening, or misleading content
• List new, mass-produced, or commonly available retail merchandise in the Collective / Booth Gallery (see Section 4)
• Misrepresent item condition, age, provenance, or authenticity
• Engage in price gouging or deceptive pricing practices
• Create fake accounts, impersonate other users, or misrepresent your identity
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Interfere with the operation, security, or performance of the Platform
• Scrape, harvest, or collect data from the Platform without express written authorization
• Circumvent any content moderation, security, or access control measures
• Use automated bots or scripts to interact with the Platform without authorization

14. Interstate Commerce & Compliance

The Platform facilitates connections between buyers and sellers across all 50 United States.

Users are solely responsible for compliance with their own state and local regulations regarding the sale and purchase of goods, including but not limited to:

• Sales tax collection and remittance
• Business licenses and permits required for selling goods
• State-specific restrictions on the sale of certain items (e.g., firearms, alcohol, certain antiques)
• Consumer protection laws applicable in their jurisdiction
• Licensing and insurance requirements for estate sale companies and auctioneers

The Platform does not provide legal, tax, or financial advice. Users should consult qualified professionals for guidance on compliance matters.

15. Third-Party Services

The Platform integrates third-party services to provide its functionality. These include but are not limited to: Supabase (database and authentication), Google Analytics (usage analytics), Stripe (payment processing), Google Cloud and Gemini (AI services), Serper / Google Lens (visual search), and Resend (email delivery).

We are not responsible for the content, policies, availability, or performance of third-party services. Your use of third-party services integrated with the Platform is subject to those services' own terms and privacy policies.

16. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We make no warranties or representations regarding:

• The accuracy, completeness, or reliability of listings
• The availability, condition, authenticity, or value of any item
• The reliability or accuracy of AI-generated data, descriptions, or pricing
• Continuous, uninterrupted, or error-free operation of the Platform
• The conduct, credentials, licensing, or reliability of any user on the Platform
• The outcome of any engagement between a homeowner and an estate sale company

17. Limitation of Liability

To the fullest extent permitted by applicable law, EstateSaleFinder.net and its owners, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, revenue, or business opportunities
• Issues arising from interactions or transactions between users
• Damages resulting from reliance on AI-generated content or pricing estimates
• Any harm resulting from unauthorized access to or alteration of your data
• Any disputes, losses, or damages arising from engagements between homeowners and estate sale companies
• Losses resulting from payment processing errors or third-party payment processor failures

18. Indemnification

You agree to indemnify, defend, and hold harmless EstateSaleFinder.net and its owners, officers, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your content, listings, or conduct on or off the Platform
• Your violation of any applicable law or regulation
• Any dispute between you and another user of the Platform

19. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, your right to use the Platform ceases immediately. Active paid subscriptions will not be refunded upon termination for cause. Any provisions of these Terms that by their nature should survive termination shall remain in effect.

20. Changes to Terms

We may update these Terms at any time by posting the revised version on the Platform. The "Last Updated" date at the top of this page will be revised accordingly.

For material changes, we will provide at least 14 days' notice by email or in-platform notification before changes take effect. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

21. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Where applicable, federal law shall also apply.

Any disputes arising out of or related to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved through binding arbitration in the State of Florida, in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against EstateSaleFinder.net. This waiver does not apply in jurisdictions where class action waivers are prohibited by law.
